DUNLOP REWARDS MEMBER TERMS & CONDITIONS

By registering as a member of the Dunlop Rewards Programme you have signified your agreement to the following terms and conditions. You must read and understand everything in these terms and conditions as they are a binding agreement between you (Member) and SRSA:

SRSA SRSA means Sumitomo Rubber South Africa (Pty) Ltd, a private company registered in terms of the company laws of South Africa.
The Rewards Card means the Rewards card issued to the Member on joining the Dunlop Rewards Programme, on which the Rand value of the Rewards earned will be loaded.
Dunlop Dealer Portal means the official password protected website that SRSA has developed to allow its dealership customers to access current product information.
The Member means the staff member at the Dunlop Dealership, who registers with the Dunlop Rewards Programme.
The Programme means the reward scheme, known as the Dunlop Rewards Programme, offered to and operated for the benefit of its Members in terms of which the Members earn points on SRSA specified activities occurring at their respective Dunlop Dealerships. (their dealership’s purchases of specified Dunlop products from SRSA.)
Rules and Formulae means the different criteria and/or actions for which Members will earn Rewards and the formulaic calculations that will determine the value of Rewards that will be awarded, which, at the sole discretion of SRSA, can be changed from time to time.
Rewards means the points (which are converted into a Rand value and credited to the Member’s Card) earned under the Programme.
Third Party Vendor means any contractor, subcontractor or agent which provides services to SRSA specifically for the Dunlop Rewards Programme.
Personal Information means information about an identifiable natural or juristic person, including but not limited to, information about gender, marital status, nationality, age, language, identity number, telephone number, email, postal or street address and financial, criminal or employment history as well as correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or any other correspondence which would reveal the contents of the original correspondence.
Process means any operation or activity, whether automated or not, concerning Personal Information, including collection; receipt; recording; organisation; collation; storage; updating or modification; retrieval; alteration; consultation; use; dissemination by means of transmission, distribution or making available in any other form, merging, linking as well as blocking, degradation, erasure or destruction of information. Processing will have a similar meaning.
Programme Administrator means a Third-Party Vendor registered in terms of the company laws of South Africa, who have been appointed to administer and manage the Dunlop Rewards Programme.
Dunlop Dealership Dunlop Dealership means the approved Dunlop Zone or Commercial branded tyre dealership which is a customer of SRSA.
Sales Data means the sales to the Dealership from SRSA as recorded in SRSA’s software programme.

Please note: Singular refers to Plural and the other way around. Days refer to calendar days.

  1. Calculation of Rewards

2.1 A member will earn Rewards in accordance with the Dunlop Rewards Programme Rules and Formulae, which shall be determined solely by Sumitomo Rubber South Africa (Pty) Ltd’s absolute discretion, which discretion will be exercised with fair judgment and in compliance with all legislation in force in the Republic of South Africa from time to time.

2.2 For Factory Sales, the calculation of your Rewards will be based on the total monthly amount of purchases, of the specified rewardable Dunlop tyre sizes or ancillary products on offer, as reflected in the SRSA sales data and Dunlop Rewards Programme communication. The total monthly Rewards earned by the Dunlop Dealership will be split equally between all the current Members of the Dunlop Dealership at the time of calculation. Should the number of Members at that Dealership change then the Rewards split will be adjusted automatically. The onus is on the Dealership to advise any changes to their compliment of Members. Only those that have applied and been accepted by SRSA count as Members.

2.3 For Consumer Sales, the calculation of your Rewards will be based on the monthly sales data, of the specified rewardable Dunlop tyre sizes or ancillary products on offer, as reflected by the point-of-sale system at the Dunlop Dealership. You are responsible for making sure that the information you give us, in order to process redemptions, is correct. We cannot be held liable for losses as a result of incorrect information you have given to us. No manual invoices will be accepted. We are not responsible for any loss arising from any failure, malfunction of electronic facilities or delay in any point-of-sale device or our supporting or shared networks, where applicable, resulting from circumstances beyond our control.

2.4 Each tyre size will be allocated a point or rand value by which the final pay-out calculation will be determined.

2.5 The rewardable sizes, their individual values and expiry date are available to all Members on the Dunlop Dealer Portal.

2.6 SRSA reserves the right to change the Rules and Formulae for calculating the value of the Rewards or how they are earned, from time to time, depending on the objectives and stockholdings of SRSA. All changes will be communicated to the Members.

2.7 We may reverse any incorrect Rewards allocated to your Rewards account by way of an account debit. If an incorrect allocation is redeemed before changes can be made, we may recover the value of these Rewards.

2.8 No warranties, purchase protection, insurance, other promises or services are given by SRSA and/or the third party vendors.

2.9 In regard to the accrual of Rewards by the Dunlop Dealership, tyres purchased by the Dunlop Dealership, upon which, Rewards have been paid out, and which are subsequently returned to SRSA, at any stage, shall result in the reduction of the Rewards earned by the Members at that Dunlop Dealership. In the event that the Reward has already been redeemed by the Member, the amount of the reduction shall be deducted from future Rewards earned in the subsequent month(s) from the Member’s Rewards. This will affect all Members equally.

  1. Qualifying as a Member

3.1 Each Member will qualify to earn rewards on the Programme only if he or she meets all the following criteria:

  1. a) He or she is employed by the approved Dunlop Zone or Commercial Dealership at registration and during membership with the Programme.
  2. b) He or she works only at the registered and approved Dunlop Zone or Commercial Dealership, see approved list dunloprewards.co.za/registration/.
  3. c) He or she is nominated, in writing, by the respective Dealer principal.
  4. d) He or she provides SRSA with a valid cell phone number, email address and identity number. Please note that no communication will be sent to phone numbers, postal addresses, or email addresses outside the Republic of South Africa.
  5. e) His or her ownership and personal details can be verified.
  6. f) He or she is a resident of South Africa and has a valid identity document or passport to prove it.
  7. g) He or she provides a valid copy of this identity document or passport.
  8. h) He or she is 18 years of age or older at the date of registration.
  9. i) He or she is an approved member of the Dunlop Rewards programme by registering on dunloprewards.co.za.

3.2 Each Member will continue to qualify to earn Rewards on the Programme only:

  1. a) As long as he or she remains an employee of the approved Dunlop Zone or Commercial Dealership;
  2. b) As long as the Dunlop Dealership is in good standing with SRSA and is deemed to be a Dunlop Dealership by virtue of a valid signed agreement with SRSA.
  3. c) If the Member keeps the Programme updated regarding his or her contact details.
  4. d) If the Member renews his or her membership prior to the expiration of the Card.

3.3 A Member may however stay on the Programme if he or she moves from one Dunlop Dealership to another, provided that this is agreed to by SRSA and the Programme administrators are advised by SRSA in advance of any such changes to the Member’s employment and contact details.

3.4 Acceptance of Membership onto the Programme and termination thereof is at the sole discretion of SRSA who will exercise fair judgment in these decisions. In making these decisions SRSA will act in compliance with all legislation in force in the Republic of South Africa, from time to time.

3.5 Cancellation by Member:

  1. a) Voluntary Membership cancellation – Should you, at any time wish to cancel your Membership, you will be required to provide notice in writing to SRSA. The Rewards which have been accumulated prior to the cancellation of your membership will be redeemable until the expiration of the Card.
  2. b) Deceased Estates – In the event of the death of a member, the Member’s Rewards will accrue up until the date of death and will be redeemable until the expiration of the Card. The executor of the estate must provide a certified copy of the Member’s death certificate as well as an official instruction as to the beneficiary to whom the Card will be allocated. If there is no nominated beneficiary, then the Rewards will be lost. This must be done through the Programme Administrator. If we do not receive an instruction within 24 months after the first notification of death, all Rewards will be lost.
  1. The Card

4.1 The Card can only be used to purchase items in accordance with the relevant banking regulations and at service providers that accept MasterCard®. Certain vendors may not accept this card for payments, including but not limited to toll operators, fuel stations, and municipal billing departments. No internet purchases can be paid for with this card.

4.2 The Card should be treated as cash (even though the monetary value held on your Card will remain virtual money) and the Programme and SRSA shall not be liable for any damages suffered by you or any third party in the event of the Card being lost or stolen or arising out of any unauthorised use of the Card by yourself and/or any other individuals.

4.3 Neither the Card nor any balance on the Card can be exchanged for cash.

4.4 In the event that transaction fees arise, the fees will be deducted from the Rewards accrued on the Card.

4.5 The Card will be activated and ready for use when you register on the Dunlop Rewards website (www.dunloprewards.co.za). You will receive an email notifying you of the Card’s activation. Activation of your Card signifies acceptance by the Member of the Terms and Conditions of the Programme.

4.6 The Rewards accrued for a month will be credited to the Card by the end of the following month.

4.7 Each Member can check his or her Card’s balance by:

  1. a) Logging into their secure account at dunloprewards.co.za
  2. b) Sending an SMS with the Card number to 34246 (SMS for Member’s cost); or
  3. c) Call the Rewards enquiry line on 010 012 6880 (charged at standard cell phone rates).
  4. d) By navigating to getmybalance.co.za

4.8 There is a maximum limit of R25 000 that can be credited to the Card. Should your unspent Rewards exceed this amount, your Card will reflect a balance of R25 000 and any amount of your unspent Reward in excess of this balance will be held in your Wallet until you choose to transfer it onto your Card.

4.9 No interest will be earned by the Member on any Rewards held in trust.

4.10 Provided that the Rewards have been legitimately loaded onto the Card, it will be deemed to have been earned by and belong to the Member, irrespective of whether or not you continue to be employed at a Dunlop Dealership.

  1. Expiration of Membership

5.1 The Dunlop Dealerships and their Members that are rewarded based on the SRSA sales data are limited to membership for a period of 6 months, after which their membership is at the discretion of SRSA. Whilst the Rewards earned in this time is deemed to be earned and not retractable, the 6 month window is intended to allow time for the Dunlop Dealership to migrate to POS-generated sales data delivered from their Dunlop Dealership’s own POS software.

5.2 The Member’s Dunlop Rewards Card will expire on the date printed on the Card. All Rewards will remain valid until the expiration of the Card. If you do not redeem your Rewards before this time, they will expire.

5.3 On the expiry of the Card, SRSA may, in its sole and absolute discretion, elect to issue a new Card to you or not to issue a new Card. When exercising its discretion in this regard, SRSA will exercise fair judgment and will act in compliance with all legislation in force in the Republic of South Africa from time to time.

5.4 In the event of SRSA electing: –

  1. a) To issue a new Card to the Member, the balance or value of the Rewards on the expired Card will be transferred to the new Card.
  2. b) Not to issue a new Card to the Member, any balance or value of the Rewards on the expired Card will be forfeited to SRSA.

5.5 On expiry of the Card it will have no value and can be disposed of.

5.6 Cancellation of Membership by SRSA.

  1. a) SRSA reserves the right to cancel your membership at any time, without notice, should they deem it necessary to do so. In the event that the Dunlop Dealership belonging to the Member is terminated by SRSA and is no longer deemed to be a Dunlop Dealership, then the membership in the Dunlop Rewards Programme will immediately be cancelled and all Rewards accrued to date of cancellation will remain payable to the Member until expiration of the Card.
  2. b) Any abuse whatsoever of the Programme and/or the Card by any Member including but not limited to a criminal offence may, upon consideration by SRSA, result in immediate cancellation and forfeiture of Rewards accrued on the applicable card. SRSA reserves the right to cancel such person’s membership.
  3. c) We will end your participation in the Dunlop Rewards Programme should you be proven to be collecting Rewards fraudulently. All Rewards fraudulently gained will be lost.

5.8 All cancellations will take effect immediately.

5.9 Closing your Dunlop Rewards Card:

  1. a) Your Dunlop Rewards Card will be closed when it expires.
  2. b) Destroy your Dunlop Rewards Card as soon as it expires.
  3. c) If your Dunlop Rewards Card is lost, stolen or damaged you can order a new Dunlop Rewards Card from the Dunlop Rewards Contact Centre at a stipulated cost or by sending an email to rewards@srigroup.co.za.

5.10 Lost or Stolen Dunlop Rewards Cards

  1. a) You are responsible for the safety of your Dunlop Rewards Card. SRSA will not be liable if your Dunlop Rewards Card is damaged, lost, stolen or copied.
  2. b) You must keep your Dunlop Rewards Card safe. If you lose your Dunlop Rewards Card or if it is stolen and used by someone else, any Rewards spent by them will be lost.
  3. c) Call 010 012 6880 immediately to deactivate your card if it is lost or stolen.
  4. d) You will be responsible for all payments made with your Dunlop Rewards Card before it is closed.
  1. Website

6.1 We are not liable for any losses incurred for you not ending a session correctly or not protecting your log-in information.

6.2 The Dunlop Rewards Programme website and the content on it may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed.

6.3 Unauthorised use of this site and / or the materials contained on it may violate applicable, copyright, trademark or other intellectual property laws or other laws.

6.4 You must use and update hardware and software (computer equipment and programs) suitable for our website. If you do not, the website may not work properly, which could increase your security risk.

6.5 We do not warrant that any file, download or application available on the communication system is safe to use on any computer. We cannot guarantee that it contains no software or data that could negatively affect a computer system, such as viruses, Trojans and other malicious software.

6.6 We may change, suspend, or close the website temporarily or permanently without notice. We may also limit certain services, features or functions, and restrict access to all or parts of any service on the website.

6.7 Your use on this website is dependent on factors beyond our control, such as the network coverage or availability of your Internet Service Provider. We are not liable for any loss or damages you may suffer if a factor beyond our control arises, and you cannot access this website.

  1. Privacy note

7.1 You expressly consent to us collecting and processing your Personal Information to:

  1. a) Open, administer and operate your Dunlop Rewards Card account.
  2. b) Monitor and analyse the conduct on your Dunlop Rewards Card account for credit, fraud, compliance, and other risk-related purposes.
  3. c) Carry out statistical and other analysis to identify potential markets and trends.
  4. d) Develop new products and services.

7.2 You expressly consent that we may:

  1. a) Process your Personal Information within SRSA for the above purposes.
  2. b) Give your Personal Information to any person who provides services to us or acts as our Third-Party Vendor or to whom we have transferred or propose to transfer any of our rights and duties in respect of your Dunlop Rewards Card account.
  3. c) Share personal information with our service providers, within South Africa, as necessary. We ask persons who provide services to us to agree to our privacy policies if they need access to any Personal Information to carry out their services.

7.3 You acknowledge that:

  1. a) SRSA will at all times remain responsible for determining the purpose of and means of processing your Personal Information.
  2. b) We are required by various laws, including FICA, to collect some of your Personal Information
  3. c) Without your Personal Information we may be unable to continue offering services to you.

7.4 You are giving us your Personal Information voluntarily.

7.5 We may make changes to information, graphics, features, functionality or services or links at any time without notice.

7.6 You may not change any of these terms.

  1. Reservation of rights by SRSA

SRSA reserves the right to alter or change any terms and/or conditions of the Programme or to terminate it at any point without notice. If the Programme is terminated, the balance held on a Member’s Card as at the date of termination will not be affected until the date of expiry of the Card. Should there still be a balance on your Card when the Card expires, such amount will be forfeited to SRSA.

  1. Cession, assignment, and disposal of rights

SRSA is entitled to sell, cede, assign, delegate or in any other way alienate or dispose of any or all of its rights and obligations under the Scheme without your prior approval.

  1. Severability

Each of these terms and conditions is severable and in the event that any one or more of them is found to be unenforceable, then the remaining terms and conditions shall remain valid and enforceable.

  1. Tax liability and Indemnity

11.1 To the maximum extent allowed by law, you hold us harmless against any loss or damage suffered by us as a result of our reliance on any warranty, representation or information given by you in relation to these terms and conditions.

11.2 SRSA reserves its right to deduct from the value of your Rewards on the Card, any amount whatsoever that it may be required in law to be paid to the South African Revenue Services (SARS) or to any other government institution arising in respect of the Rewards earned by you. The Member further agrees to irrevocably indemnify SRSA in respect of any amounts which it may be required to pay to SARS arising from the Programme and the Rewards paid to the Member. The Member undertakes to repay any such amount paid by SRSA to SARS, arising from the Programme and the Rewards paid to the Member, to SRSA within 14 days of having received a demand for such payment.

  1. Disclaimers and exclusions of liability

12.1 You expressly agree that use of the Internet is entirely at your own risk.

12.2 We do not warrant that the functions provided by the website will be uninterrupted or error free, or that the website or the server that makes it available is free from viruses or other harmful components.

  1. Disputes

Any disputes relating to the calculation of Rewards can be addressed to SRSA in writing and such dispute will be investigated by SRSA with the objective of resolving the dispute fairly. The decision reached by SRSA, after such investigation has been finalised, will be final and binding on the Member.

  1. Intellectual property rights

14.1 The logos and trademarks on our website are our registered and unregistered trademarks or those of other parties. Nothing on our website is a licence (permission) or right to use any trademark or any other intellectual property for any other purpose.

14.2 You may not, without our prior written permission, use our intellectual property or that of a third party.

14.3 Even if any content on our website is not confidential or there is no copyright in it, we own all of it and you have no rights in it.

  1. General

15.1 We will assume that you have received any notice we send you within seven (7) days of posting, or on the same day if delivered by hand or sent by WhatsApp or email.

15.2 We will comply with all applicable laws that govern the environment in which we operate.

15.3 From time to time, Dunlop Rewards Card may require Third-Party Vendor participation. In such instances, the Third-Party Vendor’s terms will apply. It is your responsibility to make sure that you understand all Third-Party Vendor’s terms.

15.4 Our website may contain hyperlinks to external websites. By making the hyperlinks available, we are not in any way endorsing the products and/or service, terms, their website, and its content.

15.5 You agree that we may sue you in the Magistrate’s Court, even if our claim against you exceeds the jurisdiction of the Magistrate’s Court.

15.6 A favour or concession we may give you will not affect any of our rights against you.

15.7 These terms are governed by South African law, despite any other country’s laws.

15.8 If we close or suspend access to your Rewards account for any reason, we will not be responsible for any loss resulting from any act or omission by us on any third party. This includes claims arising in contract, delict, or statute for direct, indirect, consequential or special damages, including loss of profit.

15.9 We are not responsible for any loss, service interruption or delay resulting from circumstances beyond our reasonable control, such as power cuts or a failure, malfunction, or delay in an electricity supply.

15.10 Address for legal notices:

The physical (street) address on your registration form is your chosen address for receiving any legal notices and documents. You must let us know immediately if your address changes.
